Terms of Service

1. Who we are

FMCG Lens is provided by Muasher AI Company (شركة مواشر إيه آي), a single-member limited liability company registered in the Kingdom of Saudi Arabia. Commercial Registration (Unified National Number) 7054820092. Registered address: Al Sufyani (السفياني), Al Andalus Dist., Jeddah 23326, Kingdom of Saudi Arabia. VAT registration number: 314914046700003. Contact: support@fmcglens.com.

In these terms, "we" and "us" mean Muasher AI Company, and "you" means the business that opens the account and the people it lets use it.

1A. Launch status

FMCG Lens is launching soon. Subscriptions are not open yet. Until we open, no plan can be bought and no one is charged. Joining the founding list is free, needs no card, and does not commit you to buy anything. The prices on our pricing page are the prices that will apply when subscriptions open. These terms apply to every account from the day it is opened.

2. Who sells to you: Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. When you subscribe, you buy from Paddle, and Paddle's Buyer Terms apply to that purchase. Paddle takes the payment, adds any tax that applies, issues your invoice, and handles billing questions and refunds together with us. 3. The agreement

By creating an account or using FMCG Lens you accept these terms, for yourself and for the business you represent. You confirm you are authorised to bind that business. FMCG Lens is a business service. It is not offered to consumers or to anyone under 18.

The Privacy Policy and the Refund Policy are part of these terms.

4. What FMCG Lens does

FMCG Lens turns the data exports a distributor already has (sales, receivables, inventory, finance, P&L and budget files) into dashboards and printable reports.

  • Every figure is calculated by our own software, in your browser, from your data. No AI calculates a figure or writes any sentence of a report.
  • Your stored files are encrypted in your browser before they are uploaded. We keep only encrypted data that we cannot read.
  • Two features use AI, both only while you map a file: recognising your columns, and the translator's helper chat. For column recognition, with your approval for that file, we send our AI provider your column headers (any header that reads as a business name is masked), value-free descriptions of each column, and the file's shape. If you use the helper chat, it also sends what you type and the conversation, your headings and the names of your file's sheets as written, and a masked outline of the file; two rows of your actual values are sent only if you approve it, and only once. The Privacy Policy gives the full detail. Column recognition can be wrong, so you confirm how each column is read before any figure is calculated.

5. Your account, your password and your recovery key

You are responsible for your sign-in details, your encryption password and your recovery key, and for everyone you allow to use your account.

Because of how the encryption works, we cannot reset or recover your encryption password or recovery key. If you lose both, your stored data cannot be recovered by us or by anyone. Keep your recovery key somewhere safe.

6. Your data

You own your data and the reports made from it. You give us only the permission we need to run the service: to store your encrypted files and their operational records, and to send the column information described in section 4 when you approve it. We claim no other rights in your data.

You are responsible for having the right to upload what you upload, including any personal data about your staff or your customers. For that personal data, your business is the controller and we act on your behalf only to provide the service, as the Privacy Policy describes.

7. Plans, prices and payment

  • Plans and prices are shown on our pricing page. Prices are in US dollars, per month or per year.
  • Taxes. Prices exclude taxes. Paddle adds any VAT or sales tax that applies at checkout and shows you the total before you pay.
  • Founding offer. The first 25 users who subscribe through the website get 20% off their first year, applied automatically at checkout, on any plan, one discounted subscription per user. From month 13 you pay the list price of the plan you signed up for.
  • Renewal. Subscriptions renew automatically for the same period (monthly or yearly), until you cancel.
  • Cancelling. You can cancel at any time from your account or by writing to support@fmcglens.com. Cancelling stops the next renewal. You keep access until the end of the period you have paid for.
  • Refunds are covered by the Refund Policy. In short: a full refund within 14 days of your first payment, for any reason.
  • Report allowance. Each plan includes the number of reports per calendar month shown on the pricing page. Unused reports do not carry over. A report that fails to generate does not count against your allowance.
  • Your price is kept. The price you sign up at stays yours for as long as your subscription continues. If we raise prices, the increase applies only to new customers, never to you. If you change plan, the new plan's price applies from the change.

8. Acceptable use

You will not:

  • try to break or test the security of FMCG Lens, or reach other customers' data;
  • upload malicious code;
  • use FMCG Lens to break the law or anyone's rights;
  • resell FMCG Lens or run it as a service for others;
  • copy or reverse-engineer it, except where the law allows;
  • use it to build a competing product.

9. Support and availability

Support is by email at support@fmcglens.com. Our support promise:

We can see whether your run succeeded and how large your file was. We cannot see your data, and we cannot be given access to it.

So please do not send us your business data or screenshots of it. We never ask for it. If we receive it, we delete it. If we need more detail, we may ask you to send the diagnostic file the product creates. It does not contain your data.

We provide FMCG Lens with reasonable skill and care. During the founding period there is no guaranteed uptime. We may change features, and we will tell you in advance about any change that materially reduces what you pay for.

10. Our property

We own FMCG Lens: its software, design and documentation. You own your data and your reports. If you send us suggestions, we may use them without any obligation to you.

11. Confidentiality

Each of us will protect the other's non-public information with at least reasonable care, and use it only for this agreement. We cannot read your stored business data; this duty covers everything we can see.

12. What we do not promise

FMCG Lens gives business analysis. It is not accounting, audit, legal, tax or investment advice, and your decisions remain yours. We work hard to make every figure right, but apart from what these terms say, the service is provided "as is", to the extent the law allows.

13. Limits on liability

To the extent the law allows:

  • neither of us is liable for indirect or consequential loss, or for loss of profit, revenue or data;
  • our total liability under these terms is limited to the greater of the fees you paid in the 12 months before the claim and USD 100.

These limits do not apply to fraud, gross negligence or wilful misconduct, or to any liability the law does not allow us to limit.

14. Your responsibility to us

You will cover us against claims by third parties arising from data you uploaded without the right to do so, or from your unlawful use of FMCG Lens.

15. Ending the agreement

You can stop at any time and delete your account in the product. Before you delete it, you can export your data.

We may suspend or close an account for a serious breach of these terms, unlawful use, or non-payment. We will give notice first where we reasonably can. When an account closes, your data is deleted as the Privacy Policy describes.

16. General

  • Events beyond control. Neither of us is liable for delay or failure caused by events beyond reasonable control.
  • Transfer. You may not transfer this agreement without our consent. We may transfer it to a company that takes over FMCG Lens, and we will tell you.
  • Notices. We write to you at your account email. You write to us at support@fmcglens.com.
  • Whole agreement. These terms, the Privacy Policy and the Refund Policy are the whole agreement between us.
  • Severability and waiver. If one clause is unenforceable, the rest still applies. Not enforcing a clause does not waive it.
  • Sanctions. You confirm that no sanctions law prohibits us from providing FMCG Lens to you.

17. Changes to these terms

We may update these terms. We will email you at least 30 days before a material change takes effect. If you continue to use FMCG Lens after that date, the new terms apply. If you do not agree, you can cancel before then.

18. Law, courts and language

These terms are governed by the laws of the Kingdom of Saudi Arabia, and the competent courts of the Kingdom of Saudi Arabia decide any dispute. They are written in English. If we publish an Arabic version and the two differ, the Arabic version prevails.
